Lone Star Legal Aid Appeals HHSC Decision to Deny Children Medical Benefits


A mother applied her two children for Children’s Medicaid six months before reaching out to Lone Star Legal Aid (LSLA), but Texas Health and Human Services (HHSC) denied her because in their system, the two children had foster care insurance.  

The mother informed Paralegal Cristina Palacios, that the children have not been in foster care for over a year. She also stated that HHSC was requesting proof of the children not being on foster care insurance, but our client did not have proof. 

We informed the client that we can submit a new application on her behalf and appeal their decision. We also advised the client that children in Texas without health insurance may get low cost or free health coverage from the Children’s Medicaid. The program covers office visits, prescription drugs, dental care, eye exams, glasses, etc. Families with children who get Children’s Medicaid pay nothing for health care coverage.  

LSLA reversed HHSC’s decision, and both children were approved.
